2. Scope
These terms govern the sale and the rental of equipment through this website and our premises in Madrid. By placing an order you accept these terms. Our Privacy Policy, Return Policy and Shipping Policy form part of these terms.
We may update these terms. The version in force is the one published on this page at the time you place your order.
3. Consumers and professional customers
Certain rights under Spanish and EU consumer law apply only to consumers — individuals acting outside their trade, business or profession. Where you order as a company, professional or self-employed person acting within your trade, those consumer-specific rights do not apply, and the provisions of these terms relating to professional customers govern instead. You may be asked to identify your purchasing capacity and to provide a CIF, NIF or EU VAT number at the time of ordering.
4. Prices and taxes
Prices are shown in euros. Unless indicated otherwise, prices are shown excluding VAT, and applicable Spanish IVA is calculated and displayed at checkout.
For business customers established in another EU member state who supply a valid VAT number verified in VIES, supplies may be zero-rated as an intra-community supply, with VAT accounted for by you under the reverse charge mechanism. Where a supplied VAT number cannot be verified, Spanish IVA will be charged.
Shipments to the Canary Islands, Ceuta and Melilla, and to destinations outside the European Union, are treated as exports and are not subject to Spanish IVA. Import duties and taxes in the destination territory are payable by the recipient.
We reserve the right to correct manifest pricing errors. Where a price is obviously incorrect, we will contact you before processing the order and you may confirm at the corrected price or cancel.
5. Orders
Your order is an offer to purchase. The contract is formed when we confirm dispatch, or in the case of rental, when we confirm the booking. We may decline an order where the item is unavailable, where the price was manifestly incorrect, or where we are unable to verify the details provided.
Product availability shown on the website is indicative. Some items are supplied to order from the manufacturer, and lead times will be confirmed to you.
6. Payment
Accepted payment methods are shown at checkout. Goods remain our property until payment has been received in full.
7. Delivery
Delivery terms, costs and destinations are set out in our Shipping Policy.
8. Withdrawal and returns
Your right of withdrawal, the exclusions that apply, and the conditions governing returns are set out in our Return Policy.
9. Legal guarantee and warranty
Goods sold to consumers are covered by the legal guarantee of conformity under Spanish law. Manufacturer warranties, where offered, apply in addition and do not limit your statutory rights.
Where a product develops a fault, contact us before returning it so that we can advise on the correct procedure and, where applicable, coordinate with the manufacturer's service network.
10. Rental
10.1 Rental agreement. Equipment rental is governed by our General Rental Terms and Conditions (Contrato y Condiciones Generales del Arrendamiento de Equipo de Sonido), which is signed before equipment is released. The summary below reflects those conditions. Where there is any difference, the signed rental agreement prevails.
10.2 Booking and identification. Rentals are subject to availability and to our confirmation. You must be legally able to enter into a rental agreement. Individuals are required to provide a copy of their DNI or equivalent identity document; companies may be asked for corporate documentation.
10.3 Rental period. The rental period runs between the dates stated on the invoice. To keep the equipment beyond the agreed period you must notify us before the period ends, obtain our written authorisation, and pay the corresponding amount.
10.4 Collection and return. Equipment is collected from and returned to our premises at C/ del General Álvarez de Castro 14, Local Bajo D, Madrid. Unless we expressly authorise otherwise, collection is from 15:00 and return is before 12:00. Equipment returned after that time may be charged an additional day of rental. The rental is only considered ended once the equipment has been handed back to us.
10.5 Payment. The full rental price stated on the invoice is payable before the equipment is released, unless another payment arrangement has been agreed. Non-payment during the rental entitles us to terminate the rental.
10.6 Condition and use. Equipment is supplied in good working order, as described on the invoice. Only suitably qualified people may operate it. It must not be used, or allowed to be used, in extreme heat or cold, in adverse weather, or in any other conditions that place it at risk given its nature.
10.7 Modification. You may not alter any technical characteristic or the internal or external appearance of the equipment without our written authorisation. If you do, you are responsible for the cost of restoring it to its original condition and for compensation.
10.8 Maintenance and repairs. We bear normal mechanical wear and the cost of routine maintenance. You are responsible for the proper use of the equipment during the rental and for the cost of repairing breakdowns or damage attributable to that use.
10.9 Loss, theft and damage. You are responsible for any deterioration, loss or theft during the rental period and for the resulting costs. You must inform us immediately of any such event. Where equipment cannot be repaired, you must compensate us on the basis of its replacement value. In the event of theft you must report it to the competent authority and send us a copy of the report.
10.10 Insurance. You are required to include the rented equipment in a production insurance policy and to present that policy before collecting the equipment. If no policy is presented, you accept full responsibility for any incident affecting the equipment or any breach of these rental conditions.
10.11 No transfer. You may not assign, sell, sublet, mortgage, pledge or otherwise dispose of the equipment or any of its components without our express written consent.
10.12 Suitability and radio frequencies. We will advise on equipment selection where we can, but you remain responsible for confirming that the equipment booked is suitable for your production, including compatibility and the lawful use of radio frequencies in the territory in which you are working.
10.13 Termination for breach. Failure to comply with any of these rental conditions entitles us to terminate the rental without prior notice, and you remain bound by the obligations you have assumed.
11. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded, including consumers' statutory rights.
Subject to the above, and to the extent permitted by law, we are not liable for indirect or consequential loss, including loss of production time, loss of profit, loss of data or recordings, or costs arising from delay or interruption to a production.
12. Intellectual property
The content of this website, including text, images and layout, belongs to us or to our suppliers and may not be reproduced without permission. Brand and product names belong to their respective owners.
13. Personal data
We process personal data in accordance with our Privacy Policy and applicable data protection law.
14. Governing law and disputes
These terms are governed by Spanish law.
If you are a consumer, you may bring proceedings in the courts of your place of residence, and nothing in these terms affects your right to do so. You may also be able to submit a complaint to the consumer arbitration system (Sistema Arbitral de Consumo).
Where you contract as a company, professional or self-employed person, the parties submit to the courts of Madrid, Spain.
